Travelbay General Terms & Conditions

Your contract with Travelbay commences upon Travelbay providing you with a booking confirmation (not upon payment).

  • You warrant that you are over eighteen and have sufficient funds to pay for travel services.
  • Please note that each tour and holiday on the website and all tailor-made and custom tours are provided with Specific Terms & Conditions, Booking Process, Inclusions & Exclusions and these apply in addition to these General Terms & Conditions.
  • By purchasing this tour/holiday package you warrant that you have read, understood and agreed to the Specific and General Terms & Conditions in addition to Travelbay’s Refund Policy and Travelbay’s Privacy Policy. Please contact us if you would like a copy of any of these Terms & Conditions.
  • For cancellation and refund information, please refer to Travelbay’s Refund Policy.
  • All prices listed are in US Dollars unless otherwise stated ( you can use the conversion tool to check the price in your currency which may vary depending on the exchange rate of that day) and includes GST where payable. Prices are subject to change at the discretion of the supplier, prior to booking. This is out of the control of the agent. The listed/quoted price is guaranteed once paid in full. Please refer to Travelbay Payment Terms for more information.
  • If booking for third parties, you further warrant that you have conveyed all the above-mentioned Terms & Conditions to them
  • A service and agent fee of US $150 per person is included in the listed/quoted price of the tour/holiday package. The fee is non-refundable.
  • It is your responsibility to ensure you have a valid visa if required. For more information on visa requirements please contact your local high commission/embassy. If you need any information then please contact us on ( email id link or contact us) and we will be glad to help you with the information  
  • It is also your responsibility to ensure that you hold a passport that is valid for at least six months beyond your date of return. If you hold multiple passports, you may be required to present your passport of residence on departing that country. If you hold a passport for a country to which you are travelling, you may be obliged to produce that passport upon entering the country. Accordingly, you could be obliged to carry more than one passport when travelling overseas. You should make your own enquiries in relation to your specific circumstances and requirements.
  • Passport and visa regulations can change and it is your responsibility to ensure that you possess the relevant travel documents before you travel. Delays can be experienced in obtaining a passport or visa, so you are advised to apply in plenty of time.
  • Travelbay accepts no responsibility in any regard in relation to customers who are denied entry to a country because they do not possess the correct travel documents. 
  • Travelbay does not book international flights or Insurance so for flight and insurance, it is your responsibility to confirm all details are correct before purchasing either flights or an insurance policy. We do book internal flights, train, bus tickets etc as per the tour requirements, however, it is your responsibility to ensure that all your details are recorded correctly. Any request for a name change after documents have been issued may incur amendment fees or result in the original booking being cancelled and in the case of airlines, the loss of a seat. For tours, internal flights and holiday packages, it is your responsibility to notify Travelbay of any errors within 24 hours of receiving your booking confirmation.
  • When purchasing tours, cruises and other carriage and travel services, the name on the passport must match the name on the tickets otherwise you may not be able to travel and your own insurance may be invalid. If, after purchasing products or services but before travelling, any member of your party changes their name you must notify us immediately so that the necessary changes can be made to your documentation for which you may incur a fee.
  • Travelbay strongly recommends travellers obtain travel insurance and you acknowledge that recommendation has been made. Travelbay does not provide travel insurance but you can easily obtain suitable insurance through your local Insurance companies in your respective countries. 
  • For special request bookings such as stopover, extra night accommodation, airport transfers or any other travel arrangements that are not part of the tour/holiday package, Travelbay will advise you of the extra cost separately and this will be included in your overall quoted price.
  • This package, including any unused portion, cannot be exchanged for other services or cash.
  • Some accommodation providers may require that you present a credit card or cash deposit upon check-in to cover any additional expenses that may be incurred during your stay, for example, a mini-bar. You are responsible for the payment of any such additional expenses.
  • Please check baggage allowance prior to travel. The allowance may vary according to the destination, airline, cruise or coach operator. You are responsible for any excess baggage fees.
  • For any internal flight bookings, it is your responsibility to inform Travelbay of your Frequent Flyer number if you wish to claim points. Travelbay accepts no responsibility for the inability to claim points.
  • Travelbay recommends you check with your doctor as to any immunisations that you may require or that are recommended for your travels.
  • Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart.
  • For those of you who have any medical conditions please also ensure you are fit to travel and have all the medication you need with you. It is your responsibility to ensure that you meet all health entry requirements, obtain recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.
  • Many but not all suppliers have facilities for people who require assistance. If you have any disabilities or require special assistance, please let us know at the time of booking so we can check if suitable services are available.
  • It is your responsibility to review travel prohibitions, warnings, announcements and advisories issued by the relevant government agencies prior to booking travel or departing to international destinations. For all travellers, information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found on the government website of your respective countries.  Australian Government’s travel advisory and consular assistance service website currently located – to be removed at http://www.smarttraveller.gov.au and https://www.dfat.gov.au/. ( We need to see if this should be kept or just made generic as mentioned in red-  (For all travellers, information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found in their respective countries’ website) For travellers from other countries we recommend you check the travel recommendations of your country.
  • By offering reservations for travel-related products or services in relation to particular international destinations, Travelbay does not represent or warrant that travel to such points is advisable or without risk, and Travelbay is not liable for damages or losses that may result from travel to such destinations.
  • Travelbay sells tours on behalf of other Suppliers / Operators. We rely on the relevant third-party suppliers. Travelbay and the airlines, hotels and other Suppliers providing Services made available on or through this Website are independent parties and are not related parties. To the fullest extent permitted by law, Travelbay is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Upon payment for your booking, Travelbay will provide you with the full contact details of the Supplier / Tour Operator.
  • Whilst we take great care to provide clear and accurate information, there may be occasions where there are inaccuracies or errors. To the maximum extent permitted by law, Travelbay does not guarantee the accuracy of and disclaims liability for, any errors or other inaccuracies relating to the information, descriptions and activities displayed on this website and in our promotional material.
  • All accommodations and hotels are subject to change. If the stated hotel is not available a hotel of a similar standard will be booked.
  • Hotel ratings displayed on this Website and in our promotional material are intended only as general guidelines, and Travelbay does not guarantee the accuracy of the ratings. Hotel room images are representative only and the actual room occupied may vary in inclusions and décor.
  • In some circumstances, some specific products or services as contained on this website and promotional material may not be available due to circumstances beyond our control. In that situation, we will do our best to provide replacement products and / or services of a comparable nature and quality. Travelbay and our respective Suppliers make no guarantees about the availability of specific products and services.
  • Subject to Indian Consumer Law, Travelbay does not accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused by suppliers or third-party providers over who Travelbay has no direct control.
  • Neither Travelbay nor the Supplier / Tour Operator will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist acts, epidemics, pandemics, quarantine, outbreaks of infectious disease or any other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalised lack of availability or energy.
  • Travelbay is not liable for force majeure or any other event which is beyond its control. In the event that a force majeure applies, the customer will be bound by the supplier’s terms and conditions.
  • Subject to relevant laws, if Travelbay merges, sells or otherwise changes control of their business or this Website, they reserve the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that they have collected from you and any agreements they have made with you.
  • These Terms & Conditions will be governed by and construed in accordance with the laws of India. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Delhi, India. If any of these Terms & Conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms & Conditions which will continue in full force and effect.
  • Travelbay reserves all intellectual property rights, including but not limited to, copyright in material and/or services provided by them.
